DECREE DETAILING A NUMBER OF ARTICLES AND MEASURES TO IMPLEMENT THE CONSTRUCTION LAW ON MANAGEMENT OF CONSTRUCTION ACTIVITIES

On December 30, 2024, the Government issued Decree No. 175/2024/ND-CP (ND175/2024) detailing a number of articles and measures to implement the Construction Law on management of construction activities.

The Decree takes effect from the date of signing and replaces the Government’s Decree No. 15/2021/ND-CP dated March 3, 2021 detailing a number of contents on construction investment project management and the Government’s Decree No. 53/2017/ND-CP dated May 8, 2017 stipulating a number of legal land papers for issuance of construction permits.

Decree 175/2024 includes 07 chapters, 121 articles, 02 appendices and 27 forms.

Decree 175/2024 has some notable new points as follows:

1. Fully and clearly systematize legal land papers as a basis for granting construction permits, synchronized with the Land Law 2024 and guiding documents (Article 53).

2. Supplementing regulations on underground works (Clauses 4 and 5, Article 3).

3. Decentralize the competence to appraise and inspect the acceptance test, grant of construction activity certificates and practice certificates (Articles 16, 44, 96).

4. Work construction investment projects only need to make an economic-technical report on construction investment (Clause 3, Article 5): Increase e-commerce from 15 billion to 20 billion; supplement maintenance, repair and maintenance projects in group C.

5. It is not required to provide documents on the system when carrying out administrative procedures (Clauses 4 and 5, Article 7).

6. Increase the validity period of construction practice certificates (Clause 5, Article 73): Increase the term from 05 years to 10 years.

7. Application of building information modeling (BIM) in construction activities and digital technology solutions (Clause 1, Article 8).
