DECREE DETAILING THE IMPLEMENTATION OF CERTAIN ARTICLES OF THE LAW ON PUBLIC INVESTMENT No. 58/2024/QH15

On April 8, 2025, the Government issued Decree No. 85/2025/ND-CP (Decree 85/2025), detailing the implementation of certain articles of the Law on Public Investment No. 58/2024/QH15.

Decree 85/2025 consists of 7 chapters, 56 articles, 2 appendices, and 8 templates, and takes effect from the date of signing.

Decree 85/2025 includes several noteworthy updates as follows:

1. Classification of public investment projects:
This Decree clarifies the criteria and principles for classifying public investment projects into groups A, B, and C, with specific regulations on appraisal and approval procedures.

2. Sectors utilizing public investment capital:
Public investment capital is allocated to 13 sectors, including national defense, security, education, science and technology, healthcare, culture, information, and sports.

3. Authority and procedures for investment decisions:
The Decree clearly delegates the authority and procedures for making investment decisions for programs and projects funded by the lawful revenues of state agencies and public service units.

4. Timeframes for appraisal and approval:
It stipulates specific timeframes for the appraisal and approval of public investment projects to ensure transparency and efficiency in implementation.
